DM Jewellers Terms and Conditions

AUSTRALIAN CONSUMER LAW (ACL):

  • Retailers are not required to provide a refund or replacement if you change your mind.
  • You can choose a refund or exchange if an item has a major problem.
    • The product has a problem that would have stopped someone from buying the item if they had known about it.
    • The product is unsafe.
    • The product is significantly different from the sample or description.
    • The product doesn’t do what we said it would, or what you asked for and can’t easily be fixed.
  • If the problem is not major, the retailer can elect to repair the item within a reasonable time.
  • Under Australian Consumer Law, the goods DM Jewellers Maroochydore sell to you, must be of acceptable quality within the meaning of Australian Consumer Law. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and do not result in a major failure. If the goods are not acceptable, you have the right to seek remedies provided under Australian Consumer Law. 

RETURNS POLICY:

  • Contact our friendly team on 07 5475 4037 or daniel@dmjeweller.com.au to initiate a return. Please provide your proof of purchase, including your customer order number, contact details and reason for your return. 
  • All items need to be returned with the original product tags attached and all paperwork (such as watch instructions books, and diamond certificates). 
  • Ship return package to the DMJ PO Box 824 Maroochydore QLD 4558. 
  • All postage return charges must be pre-paid. DM Jewellers Maroochydore is unable to accept cash on deliveries. DM Jewellers does not accept liability if your item is lost or stolen during shipping. To safeguard against loss, we highly recommend purchasing additional insurance coverage from Australia Post or a shipping provider. 
  • All returns are subject to inspection by our Quality Assurance team before a refund is processed.
  • By using this website, you agree to the terms of this returns policy. 
  • DM Jewellers Maroochydore reserves the right to modify our returns policy as our business needs require. 
  • DM Jewellers Gift Vouchers or prizes are not refundable to redeemable for cash. Consider all vouchers as money, they will not be honoured if lost or stolen. 
  • Please choose carefully, custom made jewellery cannot be returned or refunded. All items are made to order therefore exchanges or returns are not offered for change of mind.
  • DM Jewellers can however make minor changes to your design, within reason, even after we have started making your piece.
  • If you are unhappy with the workmanship provide by DM Jewellers, all efforts will be made to fix the piece within reason.
  • Goods are eligible for the 30 Day Change of Mind policy provided that they are in a new condition and are accompanied by proof of purchase.
  • Definition of ‘As New Condition’: The item must not have been worn; the item must be in pristine condition with no damage, scratches, or signs of wear. Determination of an item matching the definition of ‘As New Condition’ is at the sole discretion of DM Jewellers Maroochydore. 
  • Special orders and pieces of jewellery hand-made to customer specification are not eligible for the 30-Day Change of Mind Policy.

CHRISTMAS RETURNS POLICY:

Shop with peace of mind this festive season with extended returns or exchanges until January 17 January 2022, for purchases made between November 22, 2021 – December 24, 2021. In this returns policy, the expressions “we”, “us”, and “our” are a reference to DM Jewellers (Australia) Pty Ltd ABN 20 711 446 243.

TERMS AND CONDITIONS – WARRANTY:

  • DM Jewellers covers the cost of reasonable repairs under faulty materials for the first five years after purchase. If a jewellery piece shows signs of improper care, or is damaged in a way resulting other than normal wear and tear, DM Jewellers is willing to assist to fix the piece. Regular six month clean and checks are required to ensure the longevity of your piece. As estimate of the repair can be given prior to the repair taking place. Any necessary repair of all pieces will be assessed by the owner of DM Jewellers on a case by case basis.
  • DM Jewellers offer stone tightening at no charge, providing the ring is undamaged.
  • If another jeweller undertakes work on a piece custom make and designed by DM Jewellers, including resizing or repairs, this warranty will be voided. DM Jewellers encourages each client to return the piece to DM Jewellers for repairs and resizes. DM Jewellers will not take any responsibility for repairs or resizes undertaken by other jewellers.
  • Loose diamonds, coloured stones and pearls cannot be returned and an order cannot be cancelled once a deposit has been paid. All cancellations will forfeit the deposit.
  • DM Jewellers may be able to exchange the diamond, stone or pearl for you, however, this will be at the discretion of the owner and will be assessed on a case-by-case-basis.

TERMS AND CONDITIONS – REPAIR POLICY: 

We offer repairs due to user wear, production fault, lost earring mates, or any other alteration to a piece made by DM Jewellers. Elective repairs, such as ring resizing or chain lengthening, or errors by the customer typically involve a charge. They are repaired at the owner’s expense.

TERMS AND CONDITIONS – PAYMENTS:

We currently accept payments by Visa, MasterCard and American Express (surcharges apply) or bank deposit. Bank transfers are required to be cleared into DM Jewellers account before releasing the product. By using credit card upon receipt of purchase, you confirm that you are an authorized user of the credit/debit card. All credit/debit cardholders are subject to validation checks and authorization by the card issuer. If the issuer of the credit/debit card rejects authorization of payment to DM Jewellers, we will not be held liable.

  • All refunds will be paid the same way you initially paid for the goods (excluding shipping charges) within 14 days of receiving the returned items. Your refund will be credited into the same account your payment originated from; this includes credit card and PayPal payments. Your financial institution make take additional time to transfer returned funds into your account. 
  • If the original form of payment is not available, you will choose a refund onto a DM Jewellers Gift Card or product exchange. 
  • If your goods are damaged, DM Jewellers Maroochydore will pay for return shipping costs if the return results from our error or the items of damaged or defective. 
  • Items purchased from DM Jewellers Maroochydore online may be returned at DM Jewellers Maroochydore shop front at Shop 2, M1 Building, 1 Duporth Avenue, Maroochydore, QLD 4558. Please ensure you bring with you a copy of your original tax invoice to DM Jewellers to confirm your purchase details.

TERMS AND CONDITIONS – SHIPPING: 

DM Jewellers is happy to post a piece anywhere in Australia. All orders will be shipped using Australia Post Express Post. DM Jewellers will provide the Express Post shipment number to each client. All goods will be dispatched once full payment is made and completed if custom ordered.

  • DM Jewellers Maroochydore aims to send all goods purchased online within three to seven business days from the date of purchase and confirm the availability of stock. 
  • If we cannot fulfil the order due to limited stock, DM Jewellers will advise you as soon as possible and discuss alternate options.
  • DM Jewellers Maroochydore will not be held liable for any loss, expense or other damage caused by any delay in the delivery of your product. 

CONTENT OWNERSHIP: 

All content, design, information, text, images, names, likenesses, pictures, graphics, formats, code and software, technical drawings, configurations, graphics, photographs, audio and video files, scripts, links, interactive features and other material and files (collectively, “Content”) used on or incorporated into the DM Jewellers Site and In-Store, and the selection, arrangement and/or integration of all such Content are either registered trademarks, trade names, service marks, copyrights or otherwise protected property of DM Jewellers, or used under license or otherwise, and all rights thereto are specifically reserved.

You agree to comply with, and keep intact, any copyright notices, trademark notices, information, or restrictions contained in or on any Content available on, incorporated into or accessed through the Site. You may not copy, use, download, modify, frame, publish, transmit, retransmit, transfer or sell, license, reproduce, create derivative works from, distribute, perform, display, disseminate, broadcast, cache, rearrange, redistribute, alter, adapt, crop, re-size, reverse engineer, move, remove, delete or in any way exploit or make commercial use of, any material obtained through the Site, including without limitation Content, in whole or in part, directly or indirectly, without the prior written consent of the owner thereof, except as expressly permitted in this Agreement, on the Site, by DM Jewellers (and all other entities with an interest in the relevant intellectual property) in writing in each instance or under applicable law.

The DM Jewellers Site may contain links to websites and resources on the Internet that are unrelated to us and which are owned and operated by third parties (“Third-Party Sites”). DM Jewellers does not make any representations or warranties about any Third-Party Sites you may access through the Site. These links are provided solely as a convenience to you and do not constitute an endorsement by or imply that DM Jewellers sponsors, is affiliated or associated with or otherwise recommends, certifies or endorses any Third-Party Sites. We are not responsible for the contents of or any products or services offered on any Third-Party Sites. You must make your own independent decisions regarding your interactions or communications with any other website. Material available on or through Third-Party Websites may be protected by copyright and the intellectual property laws of Australia and/or other countries. The terms of such third-party sites, and not the terms and conditions of this Agreement, govern your use of that material.

Terms and conditions – DM Jewellers attempts to provide accurate and timely information. There may, however, be inadvertent technical or factual inaccuracies and typographical errors in DM Jewellers advertising and on the DM Jewellers website. We reserve the right to make corrections and changes without notice. Your use and browsing of, and any reliance by you upon the DM Jewellers Site is at your own risk and you assume responsibility associated with the Site, provided “AS IS.” DM Jewellers disclaims all warranties, conditions, representations and endorsements of any kind, either expressed or implied, with regard to the information accessed including all content and material, functions and services provided on the Site, provided without warranty of any kind, including the warranties concerning availability, accuracy, completeness, usefulness of content and information, uninterrupted access, and any warranty of title, non-infringement, merchantability or fitness for a particular purpose.   

DM Jewellers does not warrant that the DM Jewellers Site, content, materials or services will be timely, secure, uninterrupted or error free, or that defects will be corrected. If you are dissatisfied with the Site, your sole remedy is to discontinue using the Site. Any material downloaded or otherwise obtained through the use of the Site is done at your own discretion and risk, and you are solely responsible for any damage that may result.
